WILL OF JOSEPH GWYNNE

Transcript of my 3G Grandfather 58-Joseph GWYNNE (GWINE) (1748-1831) Will, executed 14 August 1826.

I Joseph Gwine of Cumberland township in the County and state of Pennsylvania being in a sound disposing mind and memory and understanding do make constitute and appoint this my last will and testament.  As it has pleased Almighty God to bless me with a portion of this worlds wealth I give and dispose of the same in the following manner (viz).  I do hereby order and direct that all my just and funeral expenses be duly paid as soon as can be conveniently after my decease.

I give and bequeath unto my beloved wife Esther the House I now live in and the use and benefit of the farm on which it stands lying between Joseph Gwynes, Jnr. line and the lane between the house and barn, together with the use of half of the Barn being at equal expense keeping the  barn in nesary repair and household furniture and kitchen utentials as my Executors shall be nesary for her to keep house with, also one Horse Creature, one saddle and bridle three cows, six sheep one bed and bedding and victualing suficient for six months after my decease, except the victualling part - the other part to be enjoyed and possessed by her during her natural life if she so long remains my widow - if otherwise then it is my will that she have and possess only the personal property above named and that absolutely:  But the use and possession of my real estate no longer than the days of her widowhood.

Item. - I will and bequeath unto my son James Gwyne the sum of fifty dollars to be paid when convenient for my Executors to collect so much of the proceeds of my Estate.

Item - I will unto my son Alfred Gwyne all that part of my farm lying South of the before mentioned lane to contain one hundred acres and allowance of six percent to him his heirs and assigns forever on condition of his paying to my Executor or Executor the sum of three hundred dollars in six yearly instalments or payments that is to say fifty dollars in each and every year from the time of my decease, till the whole be paid to be applyed to my Executors or Executor to the payment of legacies by me herein after mentioned and also to have a share Item - I give and bequeath unto my daughters Serena Long, Martha Seaton, Elizabeth Dowlin and Susanna Long, the sum of two hundred dollars, the same to be divided between them the sum to be paid by my Executors as soon as it can be collected out of my estate after my decease according to ages.

Item - I will and bequeath unto my daughters Anna & Esther Gwyne each one Bed and Bedding one Cow saddle and bridle, and the sum of one hundred dollars to be equally divided between them, the same to be paid to them as soon as can be collected after my decease.

As to the remainder of my personal estate, if any there be after paying the before mentioned legacies, it is my will and I hereby direct that the sum of thirty dollars be paid to my Grandson Cephas Gwyne or put to interest for him until he arrives to the age of twenty one years, this disposition to be made as soon as conveniently can be after my decease and the residue or remainder to be equally divided between my before mentioned daughters, and as touching my real estate hereby willed and bequeathed to my said wife Esther during her natural life or widowhood as the case may be, it is my will and I hereby authorize or direct my Executors or Executor by me herein after mentioned to sell and dispose of the same for such price or prices as can fairly be gotten, after the decease of my said wife Esther or immediately after her marriage if that event should happen, and the money thence arising fom the sale of said land on farm to be equally divided btween my before named Children namely James, Joseph, Alfred, Serena, Martha Elizabeth, Susanna, Anna and Esther.

And lastly I nominate Constitute and appoint my friends Joseph Kindsey and William Weaver both of Greene County to be Executors of this my will hereby revoking all former Wills and Testaments by me heretofore made, ratifying and confirming this and no other to be my last will and Testament.  In testamony whereof I have hereinto set my hand and seal this fourteenth day of August in the year of our Lord one thousand eight hundred and twenty-six 1826.

September 8th 1835 - It is my desire that the name of Wm. Weaver may be stricken out of the above and Eli Baily be inserted in its place. Done in presence of us the subscribers this day and year above written.

SEAL   Before me Jesse Lazear Register for the probate of Wills and granting
letters of Administration in and for the County of Greene aforesaid personally appeared William Baily Esq., Eli Baily, Joseph Kinsey, William Hopton, Joseph Gwyne and on their solemn oaths did depose and say that they were personally present and saw and heard Joseph Gwyne the Testator within named sign seal publish and declare the same as and for his last Will and Testament, and that at the time of doing thereof he was of sound and disposing mind memory and understanding to the best of their knowledge observation and belief.

WILL OF ESTHER (LAYTON) GWYNNE

Transcript of my 3G Grandmother 59-Esther (LAYTON) GWYNNE (1762-1841) Will, executed 5 April 1834.

I, Esther Gwynne of Cumberland Township, Greene County, and state of Pennsylvania being weak of body but of a sound mind and memory, and knowing The uncertainty of time here, and that all human beings are born to die, and being by Divine Providence blessed with a portion of property that I wish to dispose of in the following manner viz.
       
1st, It is my will that all my just debts and funeral expenses be first paid,
       
2nd, I will and bequeath unto my son James Gwynne the sum of one dollar with what he has received and no more
       
3rd, I will and bequeath unto my sons Joseph and Alfred the sum of one dollar each together with what they have received and no more,
       
4th, I will and bequeath unto my daughter Elizabeth Dowlin the sum of one dollar in full as above legacies
       
5th, I will and bequeath unto my daughter Susannah Long all my wearing apparel after my death as her share
 
6th, I will and bequeath unto my grandson Josephus, one horse, saddle and bridle and bedstead, bed and bedding for one bed
       
7th, I will and bequeath unto my grandson James Long the sum of twenty dollars to be put in interest until he becomes of age and the residue of my property if any there be I wish to be sold to the best advantage and the money arising equally divided between my daughters Serena Long, Martha
Seaton, Anna Richey, Esther Kinsey, and grandson Josephus share and sharealike.
       
And lastly I hereby do appoint my cherished friend Charles Swan to be my executor to audit and settle my estate according to law and in the presence of the subscribing witnesses I do acknowledge this and no other to be my last will and testament.

Furthermore, it is my will that in addition to what I have above stated willed to my grandson Josephus, I will and bequeath unto him my rifle gun powder horn and shot pouch and three yearling steer calves.  The bedstead above mentioned to be the French bedstead I now have in my possession.
